When fighting the most recalcitrant of defendants, winning the case against them is only the start. Winning the case gives you leverage against them, call them to the negotiation table and settle. This is the truth. Clients often wonder why did we fight for so many years if we had to settle in the end. My answer is “exactly that is why, so that you can settle instead of lose. Litigation is not the end of a dispute. Litigation is but one method of ending the dispute. Winning your case is not the goal; it’s a means to an end. The end is to bring you want you have wanted, whatever it takes.
