A qualified arbitrator and expert arbitration lawyer, Fareya is an arbitration and dispute resolution specialist who also utilizes her strategic problem-solving skills to structure corporate finance and equity capital markets deals.

She has been practising law in the UAE for more than 10 years, acting on several high profile and groundbreaking cases, which includes her role as:

  • lead representative and counsel in over 120 arbitration cases

  • strategic advisor in over 200 litigations in the Courts of Dubai and Abu Dhabi

  • sole negotiator over 80 settlements.
Her primary clientele consists of middle to large corporate groups and high net worth individuals who either have a stronghold in the UAE or are seeking to expand their footprint in the region.

lead advisor in a DIAC arbitration representing minority shareholder of a BVI joint venture in a corporate dispute over investments in Pakistan (applicable law: UAE, seat: Dubai, value: USD 470m).

lead advisor in an ICC arbitration representing an oil and gas development joint venture in relation to an EPC dispute involving construction of a private-infrastructure project to support oil exploration operations in Abu Dhabi (value USD 318m, applicable law: UAE, seat: Abu Dhabi).

representing a shipping company in the DIFC Courts to enforce two English Court orders issued under section 66 of the Arbitration Act 1996 (applicable law: English, seat, London, value: USD 150.2 million).

representing a public institution as lead counsel in an ICC arbitration involving a dispute over the consultancy services provided for the construction, supervision and Estidama/LEED ratings of a Zoo in Al-Ain (applicable law UAE, seat: Abu Dhabi, value: AED 99m).

advising a Water and Waste Treatment Plant manufacturer to nullify an ad hoc arbitration award (applicable law: UAE, seat: Abu Dhabi, value: AED 68m).

advisor to a shipping company in a dispute regarding enforcement and ratification of an arbitral award issued under the Rules of LMAA (applicable law: English, seat: London, value: USD 2.5 million).

advising European oil and gas companies in an arbitration dispute for the sale of oil and gas related facilities; and wrongful intervention of UAE Courts in the appointment of arbitrators in an ICC Arbitration seated in Geneva, Switzerland.

Project Finance Restructuring: Advised a project finance lender, a major Abu Dhabi based bank, to exercise step-in rights, successfully recover the project and renegotiate the development and concession agreement with the borrower’s direct counter-party.

BVI Courts, Freezing Order/ Injunction: Successfully acted for a joint venture party before the Eastern Caribbean Supreme Court, obtaining and defending an injunction restraining the release of shares worth USD 450m; and successfully resisting a challenge by the other joint venture party in the Court of Appeal.
