Fareya specialises in complex multiparty disputes and has extensive experience in relation to issues arising out of overseas proceedings brought in various common law jurisdictions.

A recognized foremost expert in the area of international arbitration and multi-jurisdictional litigation. She has in addition developed significant expertise in capital raising transactions mostly through direct private equity deals. 

She has served as counsel in over 120 arbitrations proceedings held under the rules of the International Chamber of Commerce (ICC), Dubai International Arbitration Centre (DIAC), the London Court of International Arbitration (LCIA) and the Abu Dhabi Commercial Conciliation and Arbitration Centre (ADCCAC).

Fareya also regularly acts as an arbitrator. Amongst other cases, she has acted as sole arbitrator in two real estate cases in DIAC arbitrations and chaired a domestic arbitration concerning commercial leases. 

She is sought for her experience—both as a legal advisor in devising and executing litigation strategies for disputes, and sound tactical advice that adds value to corporate strategy.

She has extensive experience in the United Arab Emirates, having worked closely with government entities, private companies and family offices.

Selective Representation

  • Defended the government of Al-Ain in an ICC arbitration for exercising an omission (also known as ‘de-scoping) clause and counterclaiming for the contractor’s failure to obtain the agreed-upon Pearl Rating for sustainability from the Abu Dhabi Urban Planning Council. (Value: AED199m; Project: Al Ain Zoo and Aquarium)
  • representing a shipping company in the DIFC Courts to enforce two English Court orders issued under section 66 of the Arbitration Act 1996 (applicable law: English, seat, London, value: USD 150.2 million).
  • advising a Water and Waste Treatment Plant manufacturer to nullify an ad hoc arbitration award (applicable law: UAE, seat: Abu Dhabi, value: AED 68m).
  • advisor to a shipping company in a dispute regarding enforcement and ratification of an arbitral award issued under the Rules of LMAA (applicable law: English, seat: London, value: USD 2.5 million).
  • advising European oil and gas companies in an arbitration dispute for the sale of oil and gas-related facilities; and wrongful intervention of UAE Courts in the appointment of arbitrators in an ICC Arbitration seated in Geneva, Switzerland.
  • Advised Abu Dhabi oil and gas development joint venture with Exxon Mobil) in preparing the case strategy to defend against USD 496m claimed by the EPC contractor in delay, disruption and change order claims.  (Project: Upper Zakum (UZ) Oil Field Accommodation & Utility Project).
